We provide these services in an expeditious and cost effective manner. Most often we are able to finalize a client's estate plan within two weeks and schedule a follow-up appointment at the time of the first meeting. Evans & Mullinix, P.A. has an experienced staff that understands our clients' needs. We strive to give value to our clients and show that through our competitive fee structure.
Basic Estate Planning: For many clients a basic estate plan, consisting of a Will, Financial Power of Attorney, Health Care Power of Attorney, Advance Directive, Living Will and Beneficiary Deeds are sufficient. In the case of minor children, it is important to name a Guardian until the child reaches the age of majority. It is also important to provide for a trustee to receive assets and to provide for the support and education of the minor children until they attain a designated age.
Trusts: A Revocable Living Trust is often recommended for more complex situations or for tax savings to utilize the federal estate tax exemption. Our attorneys will prepare the Trust document, assist with the proper funding of the Trust and provide instructions for transferring assets to the Trust. A Trust is an excellent and effective way to avoid probate.
Post-Death Administration: Evans & Mullinix, P.A. regularly advises successor trustees with the trust administration and distribution of the trust assets after death.
Probate Estate/Non-Probate Estate: When probate is necessary to settle a loved one's estate, Evans & Mullinix, P.A. regularly handles the legal requirements for probate of a Will, probate without a Will and small estate administration. In some situations it may be possible to avoid Probate. The attorneys at Evans & Mullinix, P.A. regularly advise beneficiaries and heirs concerning their rights after death and how to proceed in the most effective manner.
Guardianship-Conservatorship: When a Guardian or Conservator must be appointed to manage the affairs of a minor child or disabled adult the attorneys at Evans & Mullinix, P.A. can handle the legal issues and work closely with the Guardian or Conservator in the fulfillment of its duties.
